Proposed Amendment to North Fork Zoning District

Definition

A development code designed to implement zoning guidelines for private property that help to preserve the unique rustic character of the North Fork for its residents, landowners, and visitors, both present and future. Due to the remoteness of the North Fork and its lack of public health and safety facilities, it is imperative that future commercial development of the area be guided by a sensible commercial growth plan.

  13. Residential Business
  14. Rental Cabins

Conditional uses

  1. Coin-Operated Laundry
  2. Convenience Store
  3. Gift/Souvenir Shop
  4. Gravel Pit (excluding asphalt and concrete processing)
  5. Residential Business With More Than One Employee
  6. Hostel
  7. Private School
  8. Public Showers
  9. Restaurant
  10. Tavern

Definitions Particular to this District:

  1. DUDE RANCH: A dude ranch may be operated on a 160-acre tract of land or a series of contiguous tracts that total 160 acres or more, or where a single tract is described by deed as a "quarter section," even if actual survey proves the tract to be less than 160 acres. A dude ranch shall be defined as a resort patterned after a Western Ranch, featuring horseback riding, camping, cookouts, campfires, hay rides, trail rides and other outdoor activities of a similar nature.
     
  2. GUEST CABINS: A detached structure being an accessory to a single-family dwelling, which may or may not have cooking facilities and/or bathroom facilities. If a guest cabin is rented, it shall be deemed as a rental cabin and subject to density requirements placed upon rental cabins in this zoning district.
     
  3. RECREATIONAL VEHICLE AND CAMPING (PRIVATE, NON-COMMERCIAL USE): The placement of a recreational vehicle or tent on a parcel of land that may or may not contain an existing residence for the private, non-commercial use of the landowner or a guest.
     
  4. RENTAL CABIN: One rental cabin is allowed per tract of record regardless of acreage. Additional rental cabins may be built at a density of one for each ten acres of contiguous property owned, and discounting the fact that one rental cabin is permissible regardless of acreage owned, a person wishing to construct two rental cabins must own at least 20 acres. Standards are the same as those outlined for a guest cabin. A deed restriction shall be placed on qualifying property by a landowner when two or more rental cabins are built and placed in service.
     
  5. RESIDENTIAL BUSINESS: Any use conducted entirely within the dwelling, accessory buildings or outbuildings and carried on by a landowner, members of the landowner's family or one non-family employee, which use is clearly incidental and secondary to the dwelling, accessory buildings or outbuildings for residential purposes, and does not change the character thereof.
     
  6. RESIDENTIAL BUSINESS WITH MORE THAN ONE EMPLOYEE: A Residential Business that employs more than one non-family member for its operation.
